With my Student Art Show website, I hope to create a web based, interactive extension of the Student Art Show in the gallery. I would like to create an area where viewers can continue to view the work of USI’s students long after the exhibition is taken down. I plan to present the show in a way that mirrors the way it would be, or was, presented in the exhibition. I want to divide the student works into their own categories, so that it is easier for the viewer to find the works they want to look at. I would also like to include a sub category for the recipients of the many awards that are given to the students exhibiting in the show, so that the viewer can see those works independent of the other works, and the students who won the awards can easily find their works. I hope to make the website easy to navigate, while still visually interesting and somewhat interactive. I would like the viewer to feel almost as if they are visiting a “real” gallery and viewing the work there, but keep things easy to navigate at the same time. I also want to present the student work in a way that is respectful of the artists. Overall, I would like the site to be reflective of the artists that are exhibiting, as well as the students of USI, and the Art Department as a whole by making it a very unique and visually appealing website that is easy to navigate.

  1. What is VARA? How does it differ from copyright? Why is it important to visual artists?
  2. How does VARA define a work of visual art? What are some exclusions to VARA? Why?
  3. Define the following terms, explain their relevance to the visual artist, and answer the corresponding questions:

Right of Attribution – Does this present any disadvantage to the artist?
Right of Integrity – What are some specific protections allowed artists?
Defamation – What is the distinction between defamation and criticism?
Right to Privacy – What are some exceptions to invasion of privacy?
Right to Publicity – What are some exemptions to this protection?

  4. What is the test to determine what is obscene? Could this test bring about consensus on what is obscene or cause greatly differing judgments based on subjective standards? Explain.
  5. What is the definition of flag desecration and how does this relate to the rights an artist has to use the image of a flag in his/her work as political protest?
  6. If a photographer takes photographs of an artist’ s work on a free-lance basis, which part would normally own the photographic copyright as well as the actual negatives?
